Acting Attorney General Todd Blanche said Tuesday that Trump likely would have gone to prison had he lost the 2024 election, offering a striking assessment of the legal challenges Trump faced during his campaign.
Appearing on a podcast hosted by Sean Hannity, Blanche was asked whether Trump’s political future came down to “the White House or the big house.” Blanche responded, “Oh yeah, absolutely,” arguing that several criminal cases and appeals were still active before Trump’s election victory.

Blanche pointed specifically to federal cases in Washington and Florida, as well as Trump’s New York criminal conviction on 34 felony counts in 2024. He suggested that, absent a presidential victory, Trump could have faced a prison sentence stemming from those proceedings.
The remarks immediately reignited debate over whether Trump’s election effectively shielded him from further legal jeopardy. Supporters of the president have long argued the cases were politically motivated, while critics contend Blanche’s comments amount to an acknowledgment that Trump faced significant criminal exposure before returning to office.

Blanche, who previously served as Trump’s personal defense attorney before joining the administration, has become one of the president’s closest legal allies.
