Attorney General Merrick Garland said this to Lester Holt on NBC News last night:

“The Justice Department plans to prosecute anyone who was “criminally responsible for interfering with the peaceful transfer of power from one administration to another.”

And in another indication that the federal criminal investigation has moved beyond the Capitol rioters, the former President’s aides’ phone records have been seized.

What they’re trying to discover is specifically, what did Trump tell his allies to do as he sought to overturn the 2020 election result?

Sources told The Washington Post that there are ‘two legal areas where Trump could get ensnared.’

The DOJ could charge the former President as they did the rioters —  seditious conspiracy and conspiracy to obstruct a government proceeding.

But the Justice Department could also try to prove Trump committed fraud with the fake electors scheme not to mention the campaign he and his allies mounted to pressure DOJ officials to say the election was fraudulent when it wasn’t.
